Watch, Renewals & Portfolio Administration

A registration is the beginning of the work, not the end of it. Marks and patents lose value quietly: an opposition window closes unnoticed, an annuity goes unpaid, a class left uncovered becomes a competitor's opening. We run the bulletins, the docket and the renewal calendar as one continuous discipline, so that every deadline is met and every decision about the portfolio is taken with the file in front of you.

Most conflicts are cheapest to solve while the other side is still an application. TÜRKPATENT publishes its bulletins on a fixed rhythm, and the window to oppose a published mark runs from that date whether or not anyone noticed the publication. We screen every issue against your marks and against the variations that matter - transliterations, near-identical wordmarks, figurative elements filed in adjacent classes - and report what we find with a recommendation rather than a raw list, because a watch report that nobody can act on is not a watch service.

Deadlines fail at the seams: between the office and the client, between an outgoing attorney and an incoming one, between a group company in İstanbul and its foreign counsel. We keep one calendar for the whole portfolio - response periods, publication dates, renewal terms, annuity instalments, use-proof windows - with a fixed reminder sequence and a named person answerable for each entry. Where a period has already been missed, the question becomes which restoration route remains open and at what cost, and we answer that before anything else is filed.

An audit asks two questions that a renewal invoice never asks: is this right still earning its keep, and is anything the business actually sells left outside the scope of registration. Dormant marks kept alive out of habit consume budget that a genuine gap needs; a product line launched three years ago may sit in a class nobody filed. We map registrations against current commercial activity, flag what to prune and what to extend, and put the renewal spend on a schedule that matches the company's own priorities rather than the calendar's.

Reporting is the part that keeps a portfolio governed rather than merely stored. Each quarter you receive a single statement - what was filed, what was published, what was opposed, what falls due in the next two periods, and what we recommend doing about each. Where a watch hit or a missed period turns into litigation - an invalidation action, an infringement claim, an interim injunction, or an action to set aside a YİDK decision - that work is conducted by Devin Law & IP at devinlaw.com.tr, and we hand over the file with the record already in order.

Watching is only useful if it is narrow enough to be read and wide enough to catch the thing that matters. We set the scope with you - which marks, which classes, which markets, which spelling variants - then run bulletin, competitor and online monitoring on that scope, so each report arrives short, sorted by risk, and with the applicable deadline already calculated.

Bulletin Watch
  • Screening of every TÜRKPATENT bulletin against your registered and pending marks
  • Coverage of identical, phonetically similar and transliterated forms in the same classes
  • Cross-class review where the goods and services are commercially related
  • Figurative element search for logos, device marks and combined applications
  • Opposition deadline calculated and entered on the docket at the moment of the hit
  • Short risk-ranked report instead of an unfiltered list of publications
  • Recommendation on each hit: oppose, negotiate, monitor further or take no action
  • Coordination of EUIPO, WIPO and national bulletin watching for export markets
Competitor & Market Watch
  • Monitoring of named competitors across their trade mark, patent and design filings
  • Alerts on new applications, assignments, licence recordals and status changes
  • Tracking of oppositions and cancellation actions filed against your competitors
  • Sector-level scanning to see where a market is being fenced off
  • Watching of patent publications relevant to your own development programme
  • Notice of expiring competitor rights that open room for your filings
  • Periodic briefing that reads the filings as strategy, not as data
Domain and Marketplace Watch
  • Monitoring of domain registrations that reproduce or imitate your mark
  • Detection of typosquatting and country-extension variants of the brand name
  • Marketplace scanning for counterfeit and unauthorised listings using your mark
  • Social media account and handle monitoring for impersonation of the brand
  • Evidence capture with dated screenshots and archived listing records
  • Takedown and complaint filings through platform and registrar procedures
  • Escalation report where the volume of use suggests an organised operation
  • Follow-up to confirm removal and to log repeat offenders
Why the bulletin mattersA published application becomes a registration if nobody objects within the statutory period. Opposition at that stage costs a fraction of a cancellation action later, and it is available only to those who saw the publication in time.
Scope set before the first reportWe agree at the outset which marks, classes and markets are watched and how close a similarity has to be before it is reported. A scope that is never defined produces either silence or noise, and both are read the same way.
Every hit carries a dateA watch notice without the deadline attached is half a service. Each reported publication reaches you with the last day for opposition already calculated, entered on the docket, and repeated in the reminder sequence until a decision is recorded.
Watching in export marketsExport markets need their own watch. We coordinate bulletin monitoring at EUIPO and in the national offices where you sell, so a conflicting filing in a distribution market is caught on the same cycle as a domestic one.

Renewal is administration until it is missed, and then it is a lost right. We hold the whole portfolio on one docket with a fixed reminder sequence, instruct renewals well before the term expires, and treat the grace period as a safety margin rather than a working schedule. Where a date has already passed, we set out the restoration options and their cost honestly.

Docketing Discipline
  • One calendar covering marks, patents, designs and pending files together
  • Response periods, publication dates and use-proof windows entered at source
  • Fixed reminder sequence at six months, three months and one month
  • A named person answerable for every entry on the docket
  • Clean handover protocol when a portfolio arrives from a previous representative
  • Cross-checking of official records against our own entries each quarter
  • Written confirmation to you once an instruction has actually been filed
Renewal Programmes
  • Ten-year trade mark renewals instructed ahead of the statutory term
  • Annual patent fees scheduled and paid for the whole family together
  • Design renewal periods tracked across all five terms of protection
  • Consolidated renewal instructions for international registrations under the Madrid Protocol
  • Partial renewal where only part of the class list is still used
  • Single annual invoice forecast so the budget is known in advance
  • Renewal decisions taken with the audit findings and their reasoning in front of you
Restoration & Late Payment
  • Assessment of which grace period or surcharge route remains available
  • Late payment of annual fees within the additional statutory period
  • Reinstatement requests where the deadline was missed despite due care
  • Reconstruction of the evidence needed to support a restoration request
  • Re-filing strategy where restoration is no longer legally possible
  • Immediate protective filing to hold the position while options are assessed
  • Honest assessment of prospects before any restoration fee is spent
The cost of one missed dateA renewal fee is a small, predictable expense. A lapsed registration is a right that competitors may file over, a customs record that stops working, and a marketplace complaint that can no longer be made.
One calendar, not threePortfolios usually fail where systems meet: an in-house spreadsheet, a foreign associate's docket and a former representative's records. We consolidate them into a single source and reconcile it against the official register rather than trusting any one of them.
Grace periods are not a planThe additional period after expiry exists for accidents, not for scheduling. We instruct renewals inside the ordinary term and keep the surcharge window in reserve, because a grace period spent in advance leaves nothing when something genuinely goes wrong.
When a date is already goneRestoration is possible in defined circumstances and impossible in others. We say which case yours is before any fee is spent, and where the right cannot be recovered we move straight to a re-filing plan and to protecting the position in the meantime.

An audit turns a list of registrations into a picture of what the business actually protects. We compare the register against current products, markets and revenue, identify rights that no longer earn their cost and gaps that a competitor could occupy, then set the renewal budget against those findings and report on the portfolio at fixed intervals.

  • Review of dormant rights kept alive without commercial justification
  • Vulnerability check on marks approaching the five-year non-use period
  • Written report with a prioritised list of filings and cancellations
Cost Planning
  • Multi-year forecast of official fees, agent costs and translation expenses
  • Renewal spend mapped against product lines and their revenue contribution
  • Comparison of national, regional and international filing routes by total cost
  • Consolidation of renewal dates to reduce the administrative handling each year

  • Watch results reported with a recommendation rather than as raw hits
  • Immediate notification of office actions, publications and third-party filings
  • Annual portfolio review meeting to set priorities for the coming year
  • Reporting formats aligned with group companies and foreign counsel
  • Clear record of every instruction given and every action taken
What an audit findsAlmost every portfolio we review contains two things: a registration kept alive for a product discontinued years ago, and a brand in daily commercial use that was never filed at all. One is spending, the other is exposure.
Class scope and real activityClass lists are drafted at filing and rarely revisited, while businesses change what they sell every year. We compare the registered scope with current turnover and flag the goods and services that are being sold outside the protection actually held.
Budget follows priorityRenewal decisions are commercial decisions. Rather than renewing everything by default, we rank each right by the revenue it supports and the risk of losing it, so the same budget buys protection where the business is actually exposed.
Reporting you can act onA quarterly statement sets out what changed, what falls due, and what we recommend for each file. It is written so that a board member can read the first page and a trade mark manager can work from the rest.
