Domain Names & Digital Assets

A domain name is usually the first place a brand appears and the first place it is copied. We build domain portfolios in step with trademark filings, handle .tr allocation documents and renewals, and pursue recovery through UDRP, URS and .tr dispute panels. Where the copy sits on a marketplace, a social platform or an app store, we prepare the takedown file and follow it to its result.

Registering a trademark and securing the matching domain are the same decision taken twice. We check availability at the same time as the trademark search, so a name that clears the register does not fail on the address bar. The portfolio is then set out deliberately: the primary domain, the defensive registrations that block the obvious variations, the country extensions that match the export plan. Each record carries a renewal date, a registrar account and a named owner, because most domains are lost through an expired payment card rather than through an attack.

The .tr namespace has its own rules. Allocation still depends on documents proving the connection between the applicant and the requested name: a trademark certificate, a trade registry record, a document showing a right of use. We prepare that file, follow the allocation and keep the supporting documents where they can be produced again at renewal or transfer. Transfers between holders, changes of title after a merger and corrections to holder records all need the same care, and a record left in a former employee name is a problem waiting for a deadline.

A recovery complaint stands or falls on three elements: the disputed name is identical or confusingly similar to the right we rely on, the holder has no legitimate interest in that name, and it was registered and used in bad faith. We document each element before the complaint is written, with dated captures of the site, WHOIS history, offers to sell and any pattern of similar registrations. A panel decision transfers or cancels a name; it is not a court judgment, awards no damages and settles no wider dispute. Matters needing those outcomes are conducted by Devin Law & IP at devinlaw.com.tr.

Platforms remove quickly but rarely explain. Marketplace brand protection programmes, social network impersonation forms and app store complaint channels each accept a different proof set, and a rejected notice is harder to fix than a correct first one. We enrol the portfolio in those programmes, submit notices with registration numbers and side by side comparisons, and record what was removed and when. That record matters later: a takedown log is often the clearest evidence of scale once a matter moves beyond the platform, and it also shows repeat sellers returning under new accounts.

A domain portfolio is a register, not a collection. It has an owner, a renewal calendar, a document file behind each .tr allocation and a stated reason for every defensive name on the list. We build that register alongside the trademark portfolio and keep the two reading the same way, so a gap in one is visible from the other.

.tr Allocation & Documents
  • Checking availability of the target name across .com.tr and generic extensions
  • Preparing the document set that proves entitlement to the requested .tr name
  • Matching the applicant title with the trade registry and the trademark certificate
  • Following the allocation process and answering registry queries within the period
  • Storing allocation documents so they can be produced at renewal or transfer
  • Correcting holder records that still carry a former employee or agency
  • Advising which extensions are worth holding for the actual export markets
  • Aligning the domain step with the trademark filing rather than after it
Defensive Registrations
  • Listing typo variants, hyphenated forms and plural forms worth registering
  • Registering the common misspellings that phishing pages rely on
  • Holding country extensions that match distribution and manufacturing locations
  • Deciding which variants to register and which to leave to monitoring
  • Keeping defensive names parked and redirected to the primary address
  • Reviewing the defensive set when a new product line or slogan launches
  • Recording each defensive name against the trademark it is there to protect
Renewal and Transfer Control
  • Holding renewal dates in a single calendar with early warning periods
  • Keeping registrar accounts under company control, not personal mail addresses
  • Applying registrar and registry lock where the extension supports it
  • Managing transfers between registrars without a gap in the record
  • Updating holder details after a merger, title change or address change
  • Checking that the payment method on file will not expire before the domain
  • Preparing a written handover when an agency relationship comes to an end
Registered together, not separatelyThe domain check runs with the trademark search rather than after it. A name that clears the register but has no usable address costs a rebrand, and a name registered late has usually been registered by someone else first.
Entitlement documents for .trAllocation in the .tr namespace depends on proof of the connection between the applicant and the name. We prepare that proof, follow the allocation and keep the file where it can be produced again at renewal or transfer.
Defensive scope with a limitEvery variation can be registered, but not every variation should be. We register the misspellings that phishing and counterfeit sites actually use, and leave the remainder to monitoring rather than to an endless renewal bill.
Losses happen through expiryMost domains are lost to a lapsed card or an unread reminder, not to an attacker. Renewal dates, registrar accounts and named owners are kept in one place so the portfolio does not depend on one person remembering.

Administrative panels are quick, document based and limited. What they can do is transfer or cancel a name, and nothing beyond that. This makes evidence the whole case: the earlier right, the absence of any legitimate interest, and the bad faith visible in how the name was registered and used. We assemble that file before the complaint is written.

UDRP and URS Complaints
  • Assessing whether the three UDRP elements can be evidenced before filing
  • Choosing between UDRP transfer and the faster, narrower URS suspension
  • Drafting the complaint around the right relied on and its registration date
  • Selecting the provider and the panel size according to the value at stake
  • Answering a response that claims a legitimate interest or descriptive use
  • Following implementation of a transfer decision with the registrar
  • Explaining what a panel decision does and does not resolve
.tr Dispute Resolution
  • Preparing objections through the .tr dispute resolution mechanism and its providers
  • Showing the earlier right and its use in Turkey with dated evidence
  • Meeting the language and document requirements of the Turkish procedure
  • Tracking the response period and the appointment of the dispute panel
  • Coordinating a .tr objection with a parallel complaint in generic extensions
  • Implementing the outcome with the registrar and updating the portfolio record
  • Keeping the decision on file for later disputes over the same name
Evidence & Bad Faith
  • Capturing the disputed site with dated screenshots before it changes or disappears
  • Retrieving WHOIS records and the history of changes in the holder
  • Collecting offers to sell the name at a price above registration cost
  • Identifying a pattern of similar registrations held by the same person
  • Documenting redirection to a competitor, a parking page or a counterfeit shop
  • Obtaining mail records where the name is used for deceptive correspondence
  • Organising the file so each element of the complaint has its own exhibit
Three elements, one fileA complaint succeeds only where all three elements are shown together. Identity or confusing similarity with an earlier right, no legitimate interest on the holder side, and registration and use in bad faith all come out of the same evidence file.
A panel is not a courtA panel decision moves or cancels a domain name. It awards no compensation, imposes no penalty and reaches nothing beyond the name in dispute. Matters needing those outcomes are conducted by Devin Law & IP at devinlaw.com.tr.
Evidence has a short lifeA disputed site is edited or taken down as soon as a complaint arrives. Screenshots, WHOIS history and sale offers are captured while they still exist and dated at the time of capture, because they cannot be reconstructed afterwards.
After the transfer decisionA decision in your favour is not the end of the file. The registrar has to implement it, the name has to move into the company account, renewal has to be set and the record has to join the portfolio with the decision attached.

Platform channels are the fastest way to remove a copy, but each one asks for a different proof set and none of them explains a rejection. We keep registrations enrolled, notices in the format the channel accepts, and a log of what was removed and when, so the pattern is visible when the same seller comes back.

Marketplace Takedowns
  • Enrolling registrations in marketplace brand protection programmes before problems appear
  • Preparing notices with registration numbers, listing links and comparison images
  • Reporting counterfeit listings and unauthorised use of product photographs
  • Answering counter notices where the seller disputes the removal
  • Tracking repeat sellers who return under a new account name
  • Logging removals with their dates, listing details and outcomes
  • Escalating within the platform when notices are rejected on formal grounds
Social Media Impersonation
  • Reporting accounts that copy the brand name, logo or profile presentation
  • Using the impersonation and trademark channels rather than general reports
  • Documenting the account before reporting, since deleted content cannot be recovered
  • Recovering handles identical to the brand where the platform permits release
  • Handling fake customer service accounts that collect payments from followers
  • Coordinating reports across platforms when one operator runs several accounts
  • Advising staff on what to preserve when a fake account is noticed
App Stores & Ad Networks
  • Filing trademark complaints against applications copying the name or icon
  • Reporting listings that use the brand in title or keyword fields
  • Addressing search advertisements bidding on the brand as a keyword
  • Reporting advertisement creatives that reproduce the logo without authorisation
  • Following the store dispute process through to removal or amendment
  • Recording each complaint so repeated infringement can be shown as a pattern
  • Reviewing store and network policies whenever a channel changes its rules
Enrol before the incidentBrand protection programmes verify registrations before they accept notices, and that verification takes time. Enrolling while nothing is wrong means the first counterfeit listing is reported the same day rather than after a fortnight of account setup.
The notice format decidesThe same complaint is accepted or rejected depending on the fields it fills. Registration numbers, the exact listing link and a side by side comparison do far more than a description of the problem written in free text.
Capture before reportingA reported account or listing disappears, and the evidence of what it did goes with it. The page, the seller details and the sales figures where visible are captured first, so the record survives the removal.
A log becomes the patternIndividual removals look small on their own. A dated log of fifty of them, tied to the same operator across marketplaces and social accounts, is what shows the scale once a matter has to go further than a platform form.
